Helping You Decide Your Best Course of Action
When you have debts you cannot keep up with, or have fallen behind on, filing for bankruptcy can be a viable solution to get you back on track. Our Overland Park bankruptcy attorney can help you through every step of the process.
As an overview, filing for either Chapter 13 or Chapter 7 bankruptcy involves:
Filing documents with the court, disclosing your income, your assets, your debts, and other relevant information
Attending a meeting of creditors, which is a brief question-and-answer session
Receiving a discharge of your debt, with some exceptions such as back child support or student loans
Under Chapter 13 bankruptcy, we file a plan for repaying your debts, and you make one payment each month that is distributed among your creditors. At end of the designated plan period, any eligible unpaid debts are discharged. Under Chapter 7 bankruptcy, you receive a discharge of eligible debts without a repayment plan,
but assets or property not protected by applicable law must be turned over and liquidated. Most people opt to file for Chapter 13 bankruptcy, even if they qualify for Chapter 7.
